References to “writing” include emails, texts, social media messages, faxes, or any other electronic communication. Legal references include all updates or changes. Singular terms include the plural, and gender references include all genders. References to persons include corporations.
About Us
Uplift Planning Ltd is a Private Limited Company, registered in the Isle of Man under Companies Acts 1931-2004, number 137028C. Our registered address is Pear Tree Cottage, Crossag Road, Ballasalla, Isle of Man, IM9 3EF. We specialise in providing town planning advice related to Isle of Man legislation and procedures. Steven Peter Stanley our qualified Town Planner, holds a MA Hons degree in Town and Regional Planning and is a Chartered Member of the Royal Town Planning Institute (RTPI).
The Agreement
Your Agreement with us sets out the details of the services we will provide. Please read it carefully before signing. If you have any questions, just ask us!
When both you and we sign the Agreement, it becomes a legally binding contract. By signing, both parties confirm that we have provided or made available all necessary information, including:
- The main characteristics of the Services
- Our identity and contact details
- The total Price for the Services, including taxes, or how the Price will be calculated if not fixed
- Payment and performance details
- Our complaints handling procedures
- The duration of the Agreement, or termination conditions if it is ongoing or auto-renewing
Price and Payment
The Price for the Services is detailed in your quotation.
No VAT is applicable.
We prefer electronic payments wherever possible.
Providing the Services
We commit to delivering Services with skill and care, following best practices and industry standards. We adhere to the RTPI’s byelaws, regulations, and ethical guidelines. You can find the RTPI’s Code of Professional Conduct on their website – www.rtpi.org.uk.
- Start Date: We will begin the Services on the agreed date.
- Duration: We will continue the Services for the agreed period.
- Timely Completion: We strive to complete the Services on time but are not responsible for delays outside our control.
- Additional Work: Extra work outside the agreed brief will involve additional fees, which we will estimate before starting.
- Information Needed: If we need information or action from you, we will let you know as soon as possible. Delays or incorrect information may result in extra charges or delays.
- Suspension: We may need to suspend the Services due to delays in information from you or technical issues. We will inform you in advance unless it’s an emergency.
- Non-payment: If you don’t pay for the Services as required, we may suspend them until payment is made. We will inform you in writing if this happens.
- Outcome: While we will represent you to the best of our ability, we cannot guarantee outcomes that rely on decisions made by others (e.g., government bodies).
48 Hour Express Service
By using our 48 Hour Express Planning Advice Service, you agree to the following terms and conditions. We strive to provide timely and accurate advice within 48 hours of your request; however, this timeframe is not guaranteed and may be affected by technical issues, public holidays, staff absences, or high demand. In the event of unforeseen circumstances that prevent us from meeting the 48-hour deadline, we will notify you as soon as possible and provide an estimated completion time. This service is also subject to our availability, and we reserve the right to refuse service at our discretion. We are not liable for any delays or the consequences thereof. Your use of this service constitutes acceptance of these terms.
Our Liability
We aim to provide professional services with care and skill. However, we are not responsible for losses due to incorrect or incomplete information from you or others, failure to supply necessary information, or failure to act on our advice.
Cancellation
Before Services Begin: You can cancel the Services at any time before we start. Payments for Services not yet provided will be refunded within 14 calendar days of cancellation.
After Services Begin: You can cancel anytime with 14 calendar days’ notice. Payments for Services not yet provided will be refunded within 14 calendar days of cancellation. If Services have been provided and not paid for, sums due will be deducted from any refund or invoiced to you.
